An overview of the BCEA as it pertains to leave

MODULE 2 

The causes of Absenteeism  

The module focuses on how to deal with absenteeism in the workplace; incapacity and prolonged illness in the workplace.

  • Absenteeism as it pertains to misconduct
  • Absenteeism due to ill health
  • Absenteeism due to abuse of alcohol
  • Extended absenteeism due to awop

 

MODULE 3 

Conducting Disciplinary Investigations due to absenteeism

  • Gathering information 
  • Investigating medical certificates 
  • The validity of medical certificates 
  • Validity of traditional healers certificates 
  • Collating the information in date order 
  • Evaluating the evidence 
  • Interviewing the witnesses 
  • Loco inspections 
  • Drafting charges 
  • Preparing the witnesses 
  • Preparing questions for the witnesses and the accused 
  • Preparing for the case

 

MODULE 4 

Conducting the disciplinary hearing due to absenteeism

  • How to draft the charge sheet / notice to attend a hearing  
  • Understand all fairness and equity principles  
  • Create a better understanding of required procedures during hearings  
  • Preparation for the hearing  
  • Procedure and conduct during the disciplinary hearing  
  • Procedure and conduct during the appeal hearing  
  • Be able to prepare for such hearings  
  • Understanding and complying with the duty to keep record

 

MODULE 5

The Law of Evidence as pertaining to Absenteeism  

  • Understanding the principles of the law of evidence as pertaining to absenteeism 
  • Applying the principles of the law of evidence 
  • Evidence that is admissible and inadmissible evidence  
  • Cross examination techniques  
  • Rules of case presentation, evidence, examination and cross examination  
  • Overview of relevant case law on absenteeism 
  • Looking at twenty different case law decisions on absenteeism 
  • Case law on HIV/AIDS and absenteeism 
  • HIV/AIDS in the workplace and its ramifications 
  • HIV/AIDS and legislation: constitution; LRA; Employment Equity Act  
  • Managing ill employees in the workplace 
  • Repatriation for ill health policy 
  • Codes of good practice on absenteeism

 

Training methodology 

The course is conducted in a fun participative way, using role-plays, workbook activities and discussion activities are used to encourage participation among delegates.

An assignment and POE is submitted on completion to ensure competence.
